California Politicians Reach Deal on Eviction Protections
The San Francisco’s moratorium on evictions is probably preempted by the California lawmakers’ Assembly Bill 3088. The troubling language is “Any extension, expansion, renewal, reenactment, or new adoption of a measure, however delineated, that occurs between August 19, 2020, and January 31, 2021, shall have no effect before February 1, 2021.” This clause may invalidate the extension of the San Francisco moratorium through September 30, 2020 that was ordered by the Mayor after August 19, 2020. However, now there is a federal law that may preempt the state law and allow the extension of the San Francisco moratorium to stand.
