National Eviction Ban Extended
President Biden extended this moratorium through March 2021.
The relief comes as the Centers for Disease Control and Prevention’s eviction moratorium was set to expire at the end of the month. More than 14 million Americans — or 1 in 5 adult renters — said recently that they’re not caught up with their rent, according to The Center on Budget and Policy Priorities. To qualify, tenants must:
- Use best efforts to obtain all available government assistance for rent or housing.
- Have individual income no more than $99,000 for 2020 (or no more than $198,000 if joint income) OR did not have to pay income tax in 2019 Or received a stimulus check.
- Be unable to pay rent due to income loss or extraordinary out-of-pocket medical expenses.
- Make best efforts for timely partial rent payment as the individual’s circumstances permit.
- Expect to be homeless or have to live in close shared quarters if evicted.
“…this Order does not preclude State, local, territorial, and tribal authorities from imposing additional requirements that provide greater public-health protection and are more restrictive than the requirements in this Order….”
Exceptions if the tenant or resident is a threat to health or safety, property, or violating any other contractual obligation other than the timely payment of rent or similar housing-related payment.
